FSH News, Universitas Sriwijaya – Prof. Dr. Muhammad Maksum, S.H., M.A., M.D.C., Dean of the Faculty of Sharia and Law at UIN Syarif Hidayatullah Jakarta, served as an External Examiner for the Open Dissertation Examination of the Doctoral Program in Law at the Faculty of Law, Universitas Sriwijaya, Palembang (Saturday, July 13, 2024). The examination was held on the 8th floor of the Faculty of Law building, with Prof. Dr. Febrian, S.H., M.S., Dean of the Faculty of Law, acting as the Chair of the Examination Panel. The Promoter for the dissertation was Prof. Dr. Joni, S.H., M.H., and the Promovendus, Cik Basir, is a Senior Judge at the High Religious Court of Palembang.

The main theme of the dissertation was "Reconstructing Procedural Law in Handling Sharia Economic Cases at the Religious Court." According to Cik Basir, the current procedural law used does not align with the philosophical, juridical, and sociological principles of Islamic law. This misalignment, he argued, leads to legal uncertainty, which in turn diminishes public trust in the judicial system.

During the examination, Prof. Maksum questioned the proposed model of reconstruction. Cik Basir offered an eclectic agglomeration scheme, which involves drawing on various relevant sources of law while adhering to Sharia principles. Prof. Maksum emphasized the importance of procedural law as a field of muamalah, which allows for innovation and adaptation in accordance with Islamic law.[MM]
