BACHELOR OF CONSTITUTIONAL LAW
The Bachelor of Constitutional Law (Siyasah) (BCL) was a division of the Jinayah Siyasah (Criminal Law and Constitutional Law) Study Programme. Previously, in 1985, this Study Programme was called Muamalah Jinayah (Islamic Civil and Criminal Law). Then, in 1995, the Muamalah Jinayah Study Programme was developed into two study programmes: Jinayah Siyasah and Muamalah. Jinayah Siyasah Study Programme focused on the study of Islamic criminal law and state administration law. Meanwhile, the Muamalah Study Programme focused on the study of Islamic economics.
In 1999, the Directorate General of Islamic Institutional Development of the Ministry of Religion of the Republic of Indonesia rearranged the licensing of study programmes within the State Islamic Higher Education (PTKIN) with the Director General of Islamic Institutional Development Decree No. E/48/99. This Decree regulated the operation of study programmes at IAIN Syarif Hidayatullah Jakarta and became the legal base for the Jinayah Siyasah Study Programme nomenclature. Following this Decree, the Rector of UIN Jakarta issued a Rector Decree No. 30 of 2000, stipulating the organisation of the Study Programmes within IAIN Syarif Hidayatullah Jakarta. This Decree determined the nomenclature of the Jinayah Siyasah Study Programme, with two concentrations: Islamic Criminal Law and Constitutional Law. On June 13, 2007, the Faculty of Sharia and Law Senate meeting agreed to change the names of those two concentrations to Jinayah Shar’iyyah and Siyasah Shar’iyyah.
In 2009, the Ministry of Religion issued the Minister of Religious Affairs Regulation (PMA) No. 36 of 2009 on the Academic Disciplines and Degree Titles in the Religious Higher Education Institutions. This Regulation was followed up with the Regulation of the Director General of Islamic Education No. 1429 of 2012 on the Organisation of Study Programmes in Islamic Higher Education Institutions. Responding to these Regulations, the Rector of UIN Jakarta applied the adjustments of Study Programme nomenclatures to the Ministry of Religious Affairs. Subsequently, the Jinayah Siyasah Study Programme is divided into two study programmes: Siyasah (Constitutional Law) and Jinayah (Islamic Criminal Law).
BCL at the Faculty of Sharia and Law of UIN Syarif Hidayatullah Jakarta aims to answer the need for potential human resources capable of integrating constitutional law and siyasah shari’yyah in constitutional practice in Indonesia. This is given Pancasila as the Indonesian legal philosophy, recognizing divine and religious values. It is expected that the study programme will be able to respond to the demand for human resources with the competence of formulating legislation. Among them are related to family law, criminal law, sharia economic law, etc. BCL sets graduate profiles as follows:
- Legal professionals (judges (especially judges in Constitutional Court), lawyers, arbiters, and mediators) who are able to implement legal theories in legal practices and in responding to constitutional issues;
- Legal researchers who are able to conduct scientific research in constitutional law and Islamic constitutional law and offer solutions to problems in that discipline;
Constitutional law experts and analysts who are able to analyse various constitutional law and Islamic constitutional law issues in the context of the nation-state
BCL was accredited based on BAN-PT Decree No. 1814/SK/BAN-PT/Akred/S/IX/2016, valid for five years up to 2021. In 2021, this Accreditation Decree was extended based on BAN-PT Decree No. 12706/SK/BAN-PT/Ak-PPJ/S/XI/2021, stipulating the Accreditation of the Constitutional Law (Siyasah) Study Programme. This Decree is effective from September 3, 2021, to September 3, 2026.
